Another Production Inc Ltd terms and conditions apply to all orders from Another Production Inc Ltd made via phone or email and are set out below. Please read through these carefully before confirming the quote and then print a copy for future reference. Please also read our Privacy Policy section regarding personal information provided by you.
1. Terms & conditions should not be varied except by agreement in writing signed by both parties.
2. Delivery charges will be charged when instructions to deliver via courier or post are given by you. This will be a standard charge depending on delivery required (A further charge is applicable if you require a weekend delivery, Fri-Mon).
3. A quote will be e-mailed. By agreeing to the quote sent by Another Production Inc Ltd you authorize the job to start and accept the price quoted.
4. You will be required to pay 50% of the quote upfront or 100% of expenses. On a fast turn around shoot (3 days or less) 75% of the quote is required up front.

6. In some instances due to rare unforeseen circumstances the brief may need to be altered. Any alterations to the brief will be confirmed with you first progressing with the order.
7. In some instances due unforeseen circumstances the cost may be higher than quoted. No further action will be taken until you approve the increased cost.
8. In order to deal with unforeseen circumstances as stated in point 9 Another Production Inc Limited will add a contingency cost to the entire quote. The amount depends on the complexity of the brief. If the excess cost does not exceed the contingency then point 9 will be irrelevant. If however the cost does exceed the contingency point 9 is relevant.
9. In some instance due to an Act of God the job cannot be completed in the time allocated. Another Production Inc Limited cannot be held accountable for time lost due to these events and the resulting impact on the quote. However, Another Production Inc Limited will make every effort to complete the job within the time and recommend that you take the weather insurance deal to cover you.
10. Another Production will invoice you the remainder of the quote, which must be paid within 30 days. Interest will be charged at 4% over the Barclays Bank base rate on all accounts over 30 days.
11. All figures provided are estimates and not a quotation. All estimate costs are VAT exclusive and valid for a period of 30 days from date of quote.
12. Back-up receipts can only be provided if requested prior to shoot confirmation. If “back-up” is required there will be an accountancy charge of 1.5% of the shoot total subject to a minimum charge of £250 and a maximum charge of £1000.
13. The entire copyright of the image is retained by the Photographer at all times throughout the world. Where Photographs are stored electronically, they must be erased at the conclusion of the agreed usage period. When the License to use the material has expired, the Photographs must be returned to the photographer in good condition within 30 days. A high-resolution digital file, pdf format file or good quality hard copy of the Photography in the context for which it was commissioned should be supplied upon request to the Photographer free of charge following publication.
14. The license to Use comes into effect from the date of payment of the relevant invoice(s). No use may be made of the Photographs before payment in full of the relevant invoice(s) without Another Production’s permission. Any permission given for prior use will automatically be revoked if full payment is not made by the due date or if the Agency is put into receivership or liquidation. Where use is restricted in the Agreement, permission to use the photographer for the other purposes will normally be granted upon payment of a further fee; to be mutually agreed. NOTE: An agreement must be reached with Another Production before the photographs may be used for other purposes.
15. It is the responsibility of the Agency to inform Another Production if they wish to extend or change the usage terms agreed. Permission to use the Photographs for purposes outside the terms of the License to Use will normally be granted upon payment of a further fee. Any estimates of usage fees to the Client are valid for a period of three months only (excepting such terms as model agencies impose) from the date of the estimate. Any unauthorized use of the Photographs will be charged at the maximum percentage stated in the Association of Photographers re-usage guidelines and will supersede any previous estimate usage. All further licenses in respect of Photographs will be subject to Another Production Limited terms and conditions. Fees negotiated for any further uses licensed will not be conditional on the exercise of the further rights granted and will be payable once invoiced.
16. The Agency and Advertiser will be authorized to publish the Photographs to the exclusion of all other persons including the Photographer. However, the Photographer retains the right in all cases to use the Photograph in any manner at anytime and in any part of the world for the purposes of advertising or otherwise promoting his/her work. After the exclusivity period indicated in the License to Use, the Photographer shall be entitled to use the Photographs for any purposes.
17. Where extra expenses or time are incurred by Another Production as a result of alteration to the original brief by the Agency or the Advertiser, or otherwise at their request, the Agency shall give approval to or be liable to pay such expenses or fees at the Photographer’s normal rate to the Photographer in addition to the expenses shown overleaf as having been agreed or estimated.
18. Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition.
19. The license only applies to the advertiser and product as stated on the quote/invoice of the form.
20. Save for the purposes of production for the licensed use(s), the Photographs may not be stored in any form of electronic medium without the written permission of the Photographer. Manipulation of the image or use of only a portion of the image may only take place with permission from Another Production Inc Ltd.
21. The contract between us shall be governed by the laws of England and Wales and any dispute between us will be resolved exclusively in the courts of England and Wales.
22. This agreement constitutes the entire agreement and understanding of the parties and supersedes all prior oral or written agreements, understandings or arrangements relating to the subject matter of this agreement. Neither party shall be entitled to rely on any agreement, understanding or arrangements not expressly set forth in this agreement save for any representation made fraudulently.
